In May 2017, Schiller McMahon obtained a $600,000 settlement from the Elizabeth Board of Education on behalf of a 35-year-old man who was sexually assaulted by his teacher in the 1990s when he was a teenager. The settlement amount reflects an overall jury verdict of $3,000,000 with the Board being 20% liable for our client’s injuries. The teacher accused of sexually assaulting our client has elected to go to trial, which is scheduled for October 2017.
In New Jersey, the statute of limitations to bring these types of claims in two years. However, the “discovery rule” allows a victim of sexual assault to toll the accrual of the statute of limitations until such time as the victim discovers, or by an exercise of reasonable diligence and intelligence should have discovered that he may have a basis for an actionable claim.
