After two and a half years of intense litigation, Schiller McMahon obtained a settlement in the amount of $850,000 from the City of Perth Amboy.
On September 5, 2013, our client was arrested at his home and charged with several criminal offenses. A trial was held on May 29, 2014 in Perth Amboy Municipal Court. At the conclusion of the trial, our client was acquitted of two charges and found guilty of two charges. Based on the convictions for these offenses, our client was incarcerated in New Jersey State Prison for 70 days. In addition, our client lost his job and was denied unemployment benefits as a result of the convictions. An appeal was immediately filed. On October 14, 2014, an Appellate Judge reversed the Trial Court’s decision and remanded the case for a new trial. The re-trial took place in the Middlesex County Superior Court on November 14, 2014. At the conclusion of the trial, our client was acquitted of all charges.
A complaint was filed in Middlesex County Superior Court alleging civil rights violations and malicious prosecution, among other claims. The City of Perth Amboy elected to resolve the case by way of settlement, which was finalized on April 29, 2016.
