The types of injury cases that we take, motor vehicle accidents, car accidents, tractor trailer accidents, motorcycle accidents, pedestrian accidents, dog bites, slip and falls, those are the types of personal injury cases that we practice.

To file a personal injury lawsuit you need two things, liability, and damages. There needs to be a liability, somebody needs to have been at fault for your injuries and you need compensation for those damages. You also have to have been damaged in some way, whether that’s because you have a broken bone, you have scaring, you have some type of permanent injury or you have substantial medical bills, lost time from work, or lost wages. Without those two elements, you cannot file a lawsuit.
A lot of people ask us how much is my case worth, and how do you calculate pain and suffering. The answer is there’s no real set formula, what we do is we’ll look at similar cases and we’ll look at what those cases have settled for or what a jury has decided that those cases are worth. Every case is different so we can’t say that there’s a standard number for pain and suffering, but we can at least get an idea of what the range that we think a type of injury is worth.
A lot of people ask us how long these cases take. These cases can take anywhere from a couple months if you’re able to resolve it quickly by way of a settlement up to two, three, sometimes even four years. The reason why it takes so long is you have two years from the date of the injury to file the lawsuit. Typically, we advise our clients not to file the lawsuit right away. A lot of people if they’ve been hurt or they’ve been injured, they want to file a lawsuit immediately and we advise them not to and the reason is that we don’t know the extent of the permanency of their injuries and that takes time. We like to give it some time so the client can get medical attention, go to their doctors, figure out what the extent of their injuries is going be, whether they’re gonna have permanent effects. Once we have an idea of whether it’s a permanent injury or how it’s gonna effect their life, we will file a lawsuit. Once you file the lawsuit you’re looking at one to two years for it to resolve.
For motor vehicle accidents, a lot of these cases can resolve without filing a lawsuit. Most of the time we’re talking about minor injuries or small liability policies or major injuries. In those cases, there’s a possibility that you can basically negotiate with the insurance company for the driver that’s at fault and even sometimes negotiate with your own insurance company if you’re dealing with an uninsured vehicle or an under-insured motorist, you can negotiate with those companies to settle the case early. Typically, what that takes is providing a settlement package to the insurance company which would include copies of medical records, any damages, any losses, whether it’s lost income, medical costs, or repairs. We provide a package to the insurance company and try and negotiate a quick resolution.
In New Jersey, you have two years from the date you are injured to file a lawsuit. If you don’t file a lawsuit within that two year period, you are precluded from filing a lawsuit. There are additional steps you need to take if the entity that you’re suing for your personal injury is a public entity. If that’s the case, you have to file what’s called a notice of tort claim with the public entity that’s responsible for your injuries within 90 days of the injury. If you fail to do that within the 90 days, you will not be able to file a personal injury lawsuit against that public entity. It’s very important to consult with a personal injury attorney immediately after you’ve been injured to ensure that all your rights are protected.
We found the most success in our personal injury cases when we’re able to sit down with somebody that’s been injured right away. The reason that we like to sit down with them right away is witnesses disappear, memories fade, and evidence disappears. What we’ll do is immediately after being retained, we will go out, we will find video cameras in the area, we’ll retain the footage from those cameras, which oftentimes will be deleted or recorded over within three days, seven days or 30 days. We’ll go out and get statements immediately, we will go on scene to any people that witnessed an automobile accident or witnessed an assault or some type of injury and we will get a statement from them when the event is fresh in their mind. We will lock them into their statement. Basically what we’re doing is we’re collecting all the valuable evidence as soon as possible before it’s gone or it goes missing. Sometimes you’ll see without that evidence you have a tough time proving your case.
